1. Agreement to Terms

By accessing or using the website at eluvexagency.com (the “Site”) operated by Eluvex Agency LLC (“Eluvex Agency,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Site or services.

2. Services

Eluvex Agency provides digital services including but not limited to website design and development, branding and visual identity, search engine optimization (SEO), marketing and growth strategy, email marketing, copywriting, social media management, business automation, and ongoing retainer services. The specific scope, deliverables, and pricing for each engagement are defined in individual project proposals or contracts.

3. Communications & SMS Consent

By providing your phone number through our website, chat widget, or contact forms, you consent to receive communications from Eluvex Agency. These may include:

• Responses to your inquiries
• Project updates and notifications
• Promotional messages, special offers, and service announcements (only if you explicitly opt in to marketing messages)

Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message. Reply HELP for assistance. Marketing consent is not a condition of purchase. Marketing consent is collected separately from transactional consent and is not bundled with any other agreement.

4. Intellectual Property

All content on this Site — including text, graphics, logos, images, and software — is the property of Eluvex Agency or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this Site without our express written permission.

Upon full payment for project deliverables, ownership of client-specific work products transfers to the client as defined in the project agreement.

5. Payment Terms

Payment terms are defined in individual project proposals. Unless otherwise agreed, Eluvex Agency requires a 50% deposit before work begins and the remaining 50% upon delivery. All payments are processed through Stripe. Late payments may incur additional fees as specified in the project agreement.

6. Limitation of Liability

Eluvex Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or this Site. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

7. Third-Party Services

Our services may integrate with third-party platforms including but not limited to Vercel, GoHighLevel, Google Workspace, Stripe, Zapier, and n8n. We are not responsible for the availability, security, or terms of these third-party services.

8. Termination

Either party may terminate an engagement with written notice as defined in the project agreement. We reserve the right to suspend or terminate access to our Site if these terms are violated.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Harris County, Texas.

10. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Site after changes constitutes acceptance of the revised terms.
